1. Who we are

Minegarden.com ("Minegarden", "we", "us") operates the Minegarden Minecraft server, website, and store. You can contact us at support@minegarden.com.

2. Scope, acceptance, and language

These Terms, together with our Privacy Policy and General Website Terms & Conditions, govern your use of the Minegarden server, website, and webstore. By accessing the server or using any Minegarden services, you agree to these Terms. If you do not accept them, you may not use the services.

We recommend saving a copy for your records. These Terms are only available in English, and the effective date above is the most recent update.

3. Eligibility

You must be at least 13 years old (or the age of digital consent in your country, whichever is higher) to use Minegarden. If you are under the required age, a parent or legal guardian must review and accept these terms for you.

Purchases may be restricted by age or local law. If you are not legally permitted to make online purchases, you must not use the webstore.

4. Accounts & access

You are responsible for maintaining the security of your Minecraft account and any credentials used to access Minegarden. You may not share, sell, or transfer your account or purchased benefits. We may suspend or terminate access for violations of these terms or to protect the community.

5. Gameplay rules and fair play

You agree to follow all server rules, community guidelines, and moderation decisions. Prohibited behavior includes harassment, cheating, exploiting bugs, scamming, or any activity that disrupts gameplay or harms others. The Minegarden rules are available at minegarden.com/rules and are incorporated by reference.

We may take enforcement action at our discretion, including warnings, temporary suspensions, or permanent bans.

6. Mods, exploits, and automation

You may only use approved mods, clients, or tools. Any mod, script, or automation that provides an unfair advantage, bypasses server mechanics, or attempts to compromise security is prohibited. Bug abuse or exploitation may result in immediate penalties.

7. Account enforcement and bans

If you violate the rules or these Terms, we may suspend or terminate your access. Enforcement decisions are at our discretion, and penalties may be applied even if the violation was unintentional.

Termination does not entitle you to refunds unless required by law. We may also disable or revoke virtual items or benefits associated with a terminated account.

Appeals may be submitted through our support channels. We review appeals on a case-by-case basis, but we are not required to reverse enforcement actions.

8. Service availability and data integrity

We do not guarantee that the server will be available at all times. Maintenance, updates, and unexpected outages may occur. We may reset, remove, or rebalance progress or items to protect gameplay and server integrity.

We are not responsible for data loss caused by factors outside our reasonable control, including third-party outages, mod conflicts, or client-side issues.

9. Webstore and purchases (if applicable)

The webstore offers optional digital items or benefits for use on the server. Purchases are licensed, not sold, for personal use on the account used at checkout. All sales are final and non-refundable except where required by law.

Virtual items have no cash value and are non-transferable unless explicitly stated. We may manage, regulate, modify, or remove virtual items at any time without compensation.

Payments are processed by third-party providers. Minegarden partners with Tebex Limited, which acts as the merchant of record and licensed reseller of digital content produced by us. To make a purchase, you must agree to Tebex’s terms at checkout. For billing issues, contact Tebex support first. For server or gameplay issues, contact support@minegarden.com.

10. User content

You retain ownership of the content you create in Minegarden, but you grant Minegarden a worldwide, non-exclusive, royalty-free license to host, display, and use that content for operating and promoting the service. You are responsible for ensuring your content does not violate any laws or third-party rights.

We may remove or restrict user-generated content that violates rules, infringes rights, or threatens the safety of the community.

11. Player-to-player disputes and scams

Trading, gifting, and cooperation with other players are at your own risk. We do not guarantee restitution for losses resulting from scams, trust trades, or player-to-player disputes, though we may take enforcement action where appropriate.

12. Intellectual property and restrictions

The Minegarden webstore, branding, and site content are owned by Minegarden or its licensors. You may not copy, modify, distribute, reverse engineer, or create derivative works from the webstore or its code, except as permitted by law.

We are not affiliated with Mojang Studios or Microsoft. All third-party trademarks are the property of their respective owners.

13. Disclaimers

Minegarden is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted service, and we disclaim all warranties to the fullest extent permitted by law.

14. Limitation of liability

To the maximum extent permitted by law, Minegarden and its operators will not be liable for indirect, incidental, special, or consequential damages arising from your use of the service. We do not exclude liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

15. Consumer rights and EU withdrawal

Nothing in these Terms limits mandatory consumer rights in your country of residence. If a Product is faulty or not as described, you may have legal remedies under local law.

EU customers may have a right of withdrawal for digital content. This right ends 14 days after purchase or when you begin to access the digital content, whichever is earlier, if you consent to immediate performance and acknowledge the loss of the withdrawal right at checkout.

16. Governing law

These terms are governed by the laws of Estonia, without regard to conflict of law principles. Any disputes must be brought in the courts located in Estonia, unless you and Minegarden agree to a different dispute resolution process.

You will also benefit from any mandatory provisions of the law of the country where you reside.

17. Changes to these terms

We may update these Terms & Conditions from time to time. We will notify users of material changes via a website notice or Discord announcement. The updated terms will take effect on the posted effective date.

18. Other important terms

We may transfer our rights and obligations under these Terms to another organization. You may only transfer your rights or obligations with our written consent. These Terms are between you and Minegarden; no third party has rights to enforce them.

Each clause operates independently. If any provision is unlawful or unenforceable, the remaining terms remain in full effect. Our failure to enforce any right is not a waiver of that right.
